The Concept of Unity in Public International Law Mario Prost 'Fragmentation' has become a defining, albeit controversial, metaphor of international law scholarship in the era of globalisation. Some scholars see it as a new development, others as history repeating itself; some approach it as a technical issue and some as the reflection of deeper political struggles. But there is near-consensus about the fact that the established vision of international law as a unitary whole is under threat. At the core of the fragmentation debate lies the concept of unity, but this is hardly ever rationalised and is more assumed than explained. Its meaning remains vague and intuitive. 'The Concept of Unity in Public International Law' attempts to dispel that vagueness by exploring the various possible meanings of the concept of unity in international law. However, eschewing one grand theory of unity, it identifies and compares five candidates. Intentionally pluralistic in its outlook, the book does not engage in normative arguments about whether international law is or should be unitary but seeks to show instead that the concept of unity is contested and that discourses on fragmentation are necessarily contingent.
The thesis on which the book is based won the 2009 Prize for best doctoral thesis from the Association des professeurs de droit du Québec.

La "fragmentación" se ha convertido en una definitoria, aunque la metáfora polémica, de la erudición del derecho internacional en la era de la globalización. Algunos expertos lo ven como un nuevo desarrollo, otros como la historia se repite; algún enfoque como un problema de carácter técnico y otras como el reflejo de las luchas políticas más profundas. Pero hay casi un consenso sobre el hecho de que la visión establecida del derecho internacional como un todo unitario está en peligro. En el centro del debate la fragmentación se encuentra el concepto de unidad, pero esto casi nunca es racionalizado y se asume más que explicado. Su significado sigue siendo vago e intuitivo. "El concepto de unidad en el Derecho Internacional Público" intenta disipar esa vaguedad mediante la exploración de los distintos significados posibles del concepto de unidad en el derecho internacional. Sin embargo, dejando de lado una gran teoría de la unidad, lo identifica y compara cinco candidatos. Intencionalmente plural en su perspectiva, el libro no se dedica a argumentos normativos acerca de si el derecho internacional es o debe ser unitaria, sino que pretende demostrar en cambio que el concepto de unidad se pone en duda y que los discursos sobre la fragmentación son necesariamente contingente.
La tesis en que se basa el libro ganó el Premio 2009 a la mejor tesis de doctorado de la Asociación de professeurs de droit du Québec.
